Some of the methods to avoid committing environmental crimes in a business are discussed. EPA's internal memos show the federal government looks at several factors before pursuing a case. The first thing they look for is public endangerment. Another factor the agencies often consider is the mindset or behavior of the violator before the violations are committed. Companies must always be responsive to an agency inspector's warning and directive to correct a violation, no matter how small that violation may seem at the time. It should perform internal environmental reviews or audits on a regular basis. The sooner a minor problem is discovered, the less costly it will be to fix. Employees do not need to be environmental experts, but do need to know enough to ask the right questions or stop a pending illegal act. Companies must always try to develop and maintain a cordial and professional working relationship with the agencies. Source

Some hazardous wastes can be discharged into a permitted wastewater treatment system. This is known as the de minimis wastewater exemption. Two types of spent solvents that can be discharged are Spent solvents containing carcinogens such as carbon tetrachloride, benzene, tetrachloroethylene, and trichloroethylene. Along the same line, there is a de minimis exemption for losses of commercial chemical products. This applies to very small amounts of commercial products that are inadvertently lost during normal material handling operations. Under 40 CFR 260.10, neutralizing waste streams that have been classified as hazardous solely because they are corrosive is allowed. So this exemption does not apply to corrosive waste streams that also contain other hazardous waste. Since methylene chloride is not a carcinogen, the maximum limit for the de minimize exemption is 25 ppm. Source

Some of the suggestions for preparing such a report include use of simple language, elimination of certain forms of presentation, and avoiding accusatory language. It is essential to break long compound sentences into shorter ones. An effective environmental audit report needs to be based on facts, including the unavailability of the weekly inspection checklist can be a valid separate finding. A power plant hired a painting contractor with a poor safety record history. Five painters perished in a fire when the contractor failed to adhere to OSHA's safety standards. The power plant faced criminal charges. Although later acquitted, the company had to pay millions in restitution and endure a public trial. A refinery with a major air permit operated without an environmental staff and endangered its neighbors and workers. Executives pleaded guilty to criminal charges. Writing better reports and memos in an environmental profession is necessary to convey our ideas to the audience. This should include focusing on one or two main issues at a time. An overloaded report with extraneous material can destroy focus. Presenting the executive summary and putting the details in the handouts is also the key. The most successful managers are always the ones who can translate technical terms into plain English for senior management and the public. Many managers use Microsoft PowerPoint at meetings to communicate complicated business proposals or technical ideas. It should be ascertained that back up of a slide presentation or report with an actual written report should be made. Effective memo and report writing is essential to good communication in the workplace. Source
